General Description

There are 3 stages of mandatory requirement that are required to be fulfilled.  EIA (Environmental Impact Accessment) is NOT required for Partial Recovery establishment.  Likewise to Full Recovery application, each of every stage detailed documentation preparation and submission to DOE for approval before next stage can be proceeded.  Presentation to DOE is very much required especially during TOR and EIA.

  2. EIA (Environmental Impact Assessment)
  3. Section 19 (Permit-to-Install)
  4. Section 18 (Permit-to-Operate)

Description & Work Itinerary

This is an official notification to DOE about the proposed project.  Also, it is a preliminary version of EIA in which it is required for DOE to determine whether the proposed scheduled waste recovery project is viable for the proposed site.  If TOR were not accepted at this stage, EIA is needless.

The following general documentation will required for TOR evaluation at DOE :

Proof of Business Operation

  1. Land title.
  2. Company/Business registration.
  3. Proof of ownership of the proposed premise.
  4. Statement of need/justification of the proposed project (refer to MIDA submittals, if any).
  5. Local authority approved architectural drawing.

Business Plan/Written Proposal

  1. Scheduled waste code(s) involved.
  2. Plant capacity & storage capacity.
  3. Details on raw material (flammable, non-flammable), chemicals used, final products and by-products for the proposed project; including maximum throughput, maximum storage volume on site, types of storages, capacity of respective storage devices, MSDS.
  4. Process flow & mass balance diagram (including all the controlled operating parameters, and ).
  5. Details of storage facilities for raw materials, products and generated wastes (including [i.] storage mode, i.e. pile yard, jumbo bag, drum, etc., [ii.] dimensions, [iii.] storage capacity).
  6. Details of the proposed plant equipment and machinery.
  7. Future expansion plans.
  8. Key, location & site plans (Drawing).
  9. Proposed equipment & material arrangement layout, including elevation views (Drawing).

Document Submission

Those document outlined above (at B. Information/Document Required) has to be compiled and submitted to DOE Regional Office to study and evaluate. The outcome will determine whether the proposed project is feasible to be conducted at the proposed area/premise. If proposed project is NOT accepted, most likely the proposed location is not suitable, etc., then change of proposed location is required.

Site Visitation

If the proposed project is viable & accepted, TOR/EIA Officers will be coming to proposed premise for site evaluation and comments. Project owner(s) and appointed TOR/EIA consultant(s) have to be available to assist TOR/EIA Officers site visitation.

Duration: 1 day (normally)

TOR Clarification Meet

After site visitation, there will be a TOR Clarification Meet at DOE Regional Office with TOR/EIA Officers for detail proposal presentation and/or clarification on Officers’ comments.

License Application under EQA 1974 Sub-Section 18(1) & 18(1A) [Permit-to-Operate]

Description & Work Itinerary

Before any production processes can be commenced, License Application under EQA 1974 Sub-Section 18(1) and 18(1A) has to be submitted to DOE and written approval obtained from DOE; otherwise, any VIOLATION will lead to plant sealing.

The following general documentation will required for TOR evaluation at DOE :

AS11 Application

  1. An official application letter with signatory from premise owner/applicant.
  2. Colored applicant’s photocopied of IC (MyKad) – certified by company secretary [1 copy].
  3. Completely filled AS-1-Pin.1/86 Form with company director’s signatory.
  4. RM100.00 processing fee, for premise license, to ‘Ketua Pengarah Kualiti Alam Sekeliling’.
  5. RM100.00 processing fee, for transportation license, to ‘Ketua Pengarah Kualiti Alam Sekeliling’.
  6. An official EIA approval letter/report for off-site full recovery from DOE (1 copy), if applicable [1 copy].
  7. Approval letter, under EQA 1974 Section 19, from DOE [1 copy].
  8. Approval letter, under Written Notification Sub-Section 4(2) Industrial Effluent 2009 for building a Industrial Effluent Treatment System (SPEP), from DOE, if applicable [1 copy].
  9. Approval letter, under Written Notification Sub-Section 5(2) Clean Air 2014 for building a air pollution control system (SKPU), from DOE, if applicable [1 copy].
  10. A1 sized as built drawings, including key & location plan and general arrangement & layout plan – certified by professional engineer [3 copies].
  11. Certificate(s) of in-house competent person(s), including CePSWAM, CePIETSO, CePSO, CePBFO etc. [1 copy].
  12. Latest company’s 6 months KWSP Form – certified by company secretary [1 copy].
  13. Documentation/Agreement with off-site full recovery facility, the tenure of the agreement should not be less than 1 year; this is applicable to partial recovery facility applicant only [1 copy].
  14. List of proposed scheduled waste generator [1 copy].
  15. List of own premise scheduled waste colleciton/transportation vehicle(s) [1 copy].
  16. Current Business License, for Scheduled Waste Recovery, from Local Council (PBT) – certified by company secretary [1 copy].

Document Submission

Those document outlined above (at B. Information/Document Required) has to be compiled and submitted to DOE Regional Office to study and evaluate. The outcome will determine whether the proposed project implementation is feasible. Amendment might be required if there is comment from DOE.

Before approval is granted from DOE, strictly NO construction should be commenced, and receiving of any scheduled waste(s) is/are NOT allowed.

Duration: The processing period for the approval of the license shall not exceed two (2) weeks (10 working days) from the date the complete submission is received.

Important Note:

  • A pre-licensing visit to the designated premises will be held in advance by the Department of Environment as a new license application may be considered. The purpose of this visit is to inspect the premise at the equipment testing & commissioning stage for scheduled waste recovery, processing and scheduled waste disposal matters.

  • The Technical Committee meeting at the Department of Environment will be held in to seek for confirmation regarding the application for a new license before the License under Section 18 (1) & 18 (1A), the Environmental Quality Act 1974 will be issued to the applicant.

  • Competent Person for Scheduled Waste Management (Buangan Terjadual, BT), Industial Effluent Treatment System (Sistem Pengolahan Efluen Perindustian, SPEP), and Air Pollution Control System (Sistem Kawalan Pencemaran Udara, SKPU), where applicable, must be get ready in advance by the applicant company.

  • The agreement or contract with the off-site full recovery facility must be submitted by the applicant who intends to operate as a off-site E-waste (SW110) partial recovery facility. The tenure should be not less than one year.
